The Avalanche is upon us
Countermeasure Injury and Death Claims continue to mount with no action by HRSA
Last month I wrote an article entitled “Here comes an Avalanche”. Highlighting the large number of claims filed with HRSA for injuries or death as a result of a declared countermeasure dealing with COVID.
The most common countermeasures are vaccines and ventilators causing the largest number of deaths and injuries.
HRSA released earlier today the December data figures in aggregate totals. You check review them here.
The accumulation of claims without any adjudication of alleged injuries or death continue to dramatically increase.
Now we are starting to see vaccine claims outpace other countermeasure claims.
Of the vaccine claims, death and blood clots are the leading claims. The non-vaccine claims, ventilators and Remdesivir continue to create the most claims.
What can we take away from this? I believe that ventilator claims will start to fall off quickly. The statute of limitations is only 1 year from the date of administration of the countermeasure. I do believe that we will see a large increase in Remdesivir claims for all non-vaccine related claims.
Also, I believe we see an increase in vaccine claims. However, many people are now figuring out the problems with the CICP and might be holding on as long as possible with the filing process, thinking there might be a chance of the vaccine moving over to the NVICP. That is highly unlikely due to the political pressure by Pharma to keep injury claims hidden in the closet, known as the CICP.
It is too early to try to correlate petition filings with FDA approvals for boosters and age groups. We have no data to tell us the age of the petitioner or other demographic information.
Since the COVID era began in March 2020, NOT ONE petition has been compensated for any COVID related injury or death. There is one pending petition since October that is waiting on benefit review.
What is a benefit review? The CICP is the payer of last resort, meaning if a successful claimant has private insurance and other benefits that exceed the designated damage award, then the CICP (our government) does not have to pay out any financial awards.
This has happened before. During the H1N1 outbreak in 2009, there were 10 claims that actually were awarded damages, mainly GBS. However, the injured parties had private insurance benefits, other medical benefits that would provide medical care for the injured person. Kind of sick isn’t it.
So we eagerly await the result of the pending claim. HRSA be performing an exhausting review of external benefits of the petitioner. Just pathetic. Cut rate auto insurance has better payouts than the CICP.
And we still do not have activity on all the rest of the claims now totally over 6,000.
