With the news of several babies receiving a RSV vaccine that was only approved for seniors 60+ age, can the parents sue the administrator of this vaccine such as a doctor, nurse or clinician?
Or what about the an injury or severe reaction to a baby with AstraZeneca’s Nirsevimab injection, a monoclonal antibody for newborns? Approved by FDA. More like rubberstamped.
Can the parents of the injured child sue AstraZeneca? Could the parents sue the doctor, the nurse or administrator of this product?
In theory yes. Legal actions against the administer of the injection for negligence? Possibly. For battery against a child? Maybe.
Against the manufacturer, AstraZeneca or Pfizer for their vaccine Abrysvo? Pfizer’s Abrysvo variant product is approved for pregnant mothers. GSK has their vaccine Arexvy for seniors 60+ years of age.
There is another set of vaccines currently being administered to adults that are running on the same track. Shingles vaccines.
Currently, the RSV vaccines and the Shingles vaccines are NOT covered in the NVICP or CICP. The manufacturers are exposed legally.
There is a large Shingles class action lawsuit still in play. In December 2022 approximately 1,100 plaintiffs and their claims that Merck’s Zostavax caused them to develop shingles was dismissed. There are still more claims causing other injuries still involved in the courts. I previously wrote about this here.
The CDC issued an alert about the RSV errors at the end of January 2024, that more than 150 women and babies were given the wrong product.
I can see why. You have 3 manufacturers and several products all approved by the FDA for a specific slice of the vaccine schedule.
According to the University of Minnesota’s Center for Infectious Disease Research and Policy (think Dr. Michael Osterholm’ playground), 25 babies received Pfizer’s RSV vaccine for pregnant mothers or GSK’s vaccine for seniors. And 128 pregnant women received the senior vaccine. No details released on how many received what type.
Several obvious questions and action alerts can be raised from this announcement.
Will those 25 babies being tracked for a few years to see if any harm, development delay or other medical conditions manifest themselves? Does the CDC even care? And if they do track them, for how long and will we be able to trust the reporting.
Same questions for the 128 pregnant mothers. Will this lead to miscarriages, the stillborn, and what will the outcome of these unborn children exposed in utero?
The issue will be, was there any harm to the child. Any immediate severe reaction such as an anaphylactic reaction or worse, seizures or death.
What about long term consequences? Development delay. It gets very muddy.
The parents would have to consult with local attorney to review statute of limitations for injury. That time period of 6 months to 3 years varies by state. Some states it is longer. And if it is determined to be a medical negligence claim, several states allow time limits of longer periods to file.
So many questions and we are only starting with the new wave of “vaccines”.
