CICP data released

July 2022

The US Federal Health Resources & Services Administration (HRSA) just released the July 2022 data showing another month of increases of petition filings in the CounterMeasures Injury Compensation Program. HRSA is a division of the US Department of Health & Human Services (HHS).

Another increase of 500 or so petitions and still no adjudication of petitions other than dismissing on grounds of “standard of proof” not met or missed filing deadline.

8,808 petitions received during the COVID era, with 5,764 vaccine related and 3,044 other countermeasures such as EUA drugs, medical devices.

In the July 1, 2022 report, HRSA continues to post one case is pending having been determined eligible for compensation. This petition/case has been pending since mid September 2021 and currently under a review of eligible expenses. What this means is all petitions determined to be eligible for compensation, a review of other benefits paid or will pay the petitioner. Private insurance, other disability payments will be deducted from any monetary determination. The CICP is the payer of last resort. Cheap bastards!

I have spoken with several petitioners about the “standard of proof” concept. Lots of confusion. And it starts with HRSA. They used a lot of contractors for different duties and processing of petitions. Lack of training by the contractors in their communications with petitioners has led to confusion, misrepresentation of HRSA policies and probably misinterpretation of existing statutes.

Another point to make is that it has taken 9 months and no final decision for the one petition submitted and determined to be compensated.

By the rate of compensation with as many as 8,800 more cases to review, I wonder if HRSA will be able to move forward before the end of the century. Seriously.
